TERMS OF USE
In these terms, the following definitions apply:
Reflection period: the period during which consumers may exercise their right of withdrawal;
Consumer: a natural person acting outside their trade, business, craft or profession;
Day: a calendar day;
Digital content: data generated and provided in digital form;
Permanent contract: a contract for regular delivery of goods, services and/or digital content over a specified period;
Durable data carrier: any tool (including email) enabling storage of information for future reference, with unchanged retention and copying capabilities;
Right of withdrawal: consumers’ right to terminate distance contracts during the reflection period;
Entrepreneur: a natural/legal person providing products, digital content and/or services remotely to consumers;
Distance contract: a contract concluded wholly/partly via remote communication technologies without physical meeting;
Sample withdrawal form: available in Annex I (not required if withdrawal right does not apply);
Remote communication technology: technologies enabling agreement without simultaneous physical presence.
Applicability
These terms apply to all offers and distance contracts between the entrepreneur and consumers.
Before concluding a distance contract, these terms must be made available to consumers. If not reasonably possible, the entrepreneur shall explain access methods and send them free of charge upon request.
For electronic contracts, terms may be provided electronically for review and storage. If unavailable, an electronic access location shall be indicated, with free delivery upon request.
If specific product/service terms apply, the above rules apply. In case of conflicts, consumers may invoke the most favorable terms.
Offers must fully and accurately describe products/services, with sufficient detail for assessment. Images must truthfully represent offerings. Obvious errors in offers are non-binding. Each offer includes information on rights/obligations related to acceptance.
Agreements are concluded when consumers accept offers and meet conditions. Electronic acceptance requires immediate electronic confirmation; consumers may withdraw until confirmation.
For electronic agreements, appropriate security measures for data transmission and payments must be implemented.
Entrepreneurs may verify consumers’ payment capabilities. Legitimate reasons for refusal allow order rejection with justification or conditional acceptance.
Upon delivery, entrepreneurs must provide (in writing or via durable data carrier): complaint address, withdrawal right details, guarantee/after-sales info, prices (including taxes/delivery), termination requirements for long-term contracts, and sample withdrawal form if applicable.
Consumers may withdraw from product contracts within 14 days via email, no justification needed. The period starts after receipt (last item for multiple products/batches).
Preferential prices remain stable except for tax changes, and include VAT.
Entrepreneurs must handle orders carefully. Delivery is to the specified address, within 30 days unless agreed otherwise. Delays/incomplete delivery require notification; consumers may withdraw and claim compensation. Risk transfers upon delivery.
Complaints must be submitted clearly within a reasonable period. Entrepreneurs respond within 14 days, or confirm receipt with expected response time for complex cases. A 4-week resolution period is required before disputes escalate.
Additional conditions must not harm consumers and be recorded in accessible written/durable form.
